Online marketplace eBay has implemented new restrictions on the sale of radio transmitting equipment in response to Federal Communications Commission (FCC) rules that took effect in October 2026. These regulations are part of a broader effort by the FCC to use its equipment authorization program to mitigate national security threats to the communications supply chain. Under the new rules, online marketplaces share a legal responsibility to ensure that unauthorized radio frequency (RF) devices are not offered for sale on their platforms.

Moving forward, equipment subject to FCC authorization must have its specific FCC ID number submitted to the marketplace and displayed within the product listing. While the FCC provides exemptions for used equipment, 'small sellers,' and listings already active on the platform, initial communications from eBay suggested a broader requirement for any equipment capable of transmitting RF energy. This shift is intended to prevent the sale of unauthorized or 'hacked' devices that could interfere with regulated services, such as emergency medical services, fire, or police communications.

In coordination with the Amateur Radio Relay League (ARRL), eBay clarified that these restrictions will not apply to devices designed to operate exclusively on frequencies allocated for Amateur Radio Service licensees. Because such amateur radio equipment does not require individual FCC equipment authorization, these listings do not need to provide an FCC ID. However, the distinction remains firm for two-way VHF/UHF equipment capable of operating outside of amateur bands; such devices cannot be imported, advertised, or sold on eBay without proper FCC certification. Sellers of amateur-only gear who find their listings affected by these automated restrictions are encouraged to contact eBay for a manual review and exemption.
